Congratulations Heather Hickey, winner of the #FerosFlashBack Competition who has won a fanatastic experience to the upcoming Cooly Rocks On Festival

The winning entry, taken back in 1964, features four year old Heather (4th from left) and her three sisters and brother are enjoying a day out in city on their way to church.

Every year Heather’s grandmother would knit matching jumpers (style and colour selected by Heather’s mum), and the children would always be dressed in identical clothes whenever they left the farm on an outing.

The car was the family’s pride and joy and saw them on family outings and holidays squeezing all eight siblings (two more were born after this photo was taken), both parents, all their luggage and food (and often with a caravan in tow too!). Of course this was back in the days before strict safety requirements – when riding in the boot and sitting on older siblings’ laps was acceptable!

Heather is super excited to be the winner of our great Cooly Rocks On Festival prize pack. She’s been a regular at CRO for several years and describes it as her “favourite festival”.

She said “it’s all about getting together with life-minded people and celebrating the culture and music from 50s and 60s. I love re-living all those good memories – and this year thanks to Feros Care #FerosFlashBack, I get to share it for the first time with my partner Patrick too”.

General

  1. Information on how to enter and prizes form part of the Terms and Conditions of Entry. Entry into this competition is deemed acceptance of these Terms and Conditions.
  2. To the extent of any inconsistency between these Terms and Conditions and any other reference to this competition, these Terms and Conditions prevail.

Who can enter

  1. Entry is open to all residents of Australia, as of the date of entry, who have fulfilled the requirements set out below (‘Eligible Entrants‘).
  2. The Promoter is Feros Care (ABN 50 104 452 271) of Level 3, The Strand, 72-80 Marine Parade, Coolangatta QLD (‘Promoter‘).

How to enter

  1. To enter Eligible Entrants must, during the Promotional Period (defined below) visit our Facebook page facebook.com/feroscare and post a video or photo of yours from the 1950’s – 1960’s PLUS use the hashtag #FerosFlashback. If contacted by the Promoter, an Eligible Entrant must provide all requested contact details in the timeframe indicated.
  2. By submitting an entry into this competition entrants consent to receive promotional and other marketing messages from the Promoter (including messages sent electronically for an unlimited period of time). Entrants will be able to opt-out at any time by following the instructions included in each message sent by the Promoter.
  3. Entrants may only enter their own original material. Inaudible, incomprehensible, illegible, copyrighted and any entry Feros Care deems to be inappropriate may be deemed invalid and removed. Entrants found to be submitting unauthorised material are invalid from the competition.
  4. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Facebook membership and the use of Facebook generally are subject to the Facebook prevailing terms and conditions of use available at www.facebook.com. Entrants understand that they are providing their information to the Promoter and not to Facebook. Entrants are solely responsible and liable for the content of their entries and any other information they transmit to other internet users via Facebook. To the extent permitted by law, each entrant agrees to indemnify, defend and forever hold harmless, Facebook and its associated agencies and companies, against any and all losses, actions, claims, costs, expenses and damages (of any nature) which may be incurred by an entrant in respect of the entrant’s participation in the promotion.   5. Eligible Entrants warrant and agree that, without limitation:
    1. they will not submit any material (Content) that is unlawful or fraudulent or that may be in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, politically incorrect, violent, abusive, harassing, threatening, racist, ageist, sexist, crude, explicit, objectionable with respect to religion, origin or gender, not suitable for children under 15, or otherwise unsuitable for publication in the context of this competition;
    2. each entry will be unique and will not infringe the rights (including intellectual property rights) of any third party;
    3. they will only submit Content which they have personally created or have the right to submit;
    4. their entry will not contain viruses or cause injury or harm to any person or entity;
    5. they have the approval of any other people who are in the entry photo (and, if the photo is of any child/children that they have the permission of all parents and/or legal guardians of the child/children depicted in the entry photo);
    6. they will comply with these Terms and Conditions and with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others’ computer or communication systems;
    7. they have the full authority to grant to the Promoter the rights referred to in these Terms and Conditions; and
    8. they will indemnify the Promoter against all costs and claims by third parties arising from a breach these Terms and Conditions.

Number of Entries permitted

  1. You can enter as many times as you like – providing that each entry is different content. Entrants found to be submitting multiple “same” entries may have all entries invalidated.

Open, Close, Judging and Publish dates

  1. The competition commences on 02/04/2017 at 09:00 AM and closes 14/05/2017 at 11:59 PM (‘Promotional Period‘). All times noted in these Terms and Conditions are local times, based on the location of the Promoter. Entries must be received by the Promoter prior to the competition close date and time.
  2. The winner will be judged by a panel of independent judges (non Feros Care Management)at Feros Care, Level 3, The Strand, 72-80 Marine Parade, Coolangatta QLD on 16/05/2017 at 11:00 AM. The Promoter will ensure that all entries have an equal chance of winning a prize.
  3. The winner will be notified by on 16/5/2017 via Facebook private message. Winner’s name will also be published on 17/05/2017 at facebook.com/feroscare plus also on www.feroscare.com.au/feros-flashback/ for 28 days.
  4. Prizes (or in the case of vouchers, prize confirmations) will be sent within 14 days of the judge.

Prize on offer

  1. The total prize pool is valued at up to $2500 (Including GST), as at 23/03/2017
  2. The prize on offer (for the One (1) winner) is:

– 3 Nights’ Accommodation for two people at Bay View Apartments Coolangatta valued at $1550.00
– $500 Webjet Voucher – valid for 12 months
– VIP CRO Parade tickets (for 2 people) – valued at $100

The winner will need to travel on the dates of 09/06/17 until 11/06/17.

  1. The winners are responsible for all other expenses not specified in the prize description including additional transport costs.
  2. Prize must be taken between 09/06/17 and 11/06/17. In the event a winner does not take the prize by the time stipulated, then the festival prize and accommodation will be forfeited by the winner and cash will not be awarded in lieu of the prize. The Webjet voucher will remain valid for the 12 months.
  3. Where the prize involves driving, travel or an event, winners and any companions under the age of 18 must be accompanied by their legal parent or guardian over the age of 18 at all times.
  4. A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges. Holidays are subject to flight and booking availabilities.
  5. By entering this competition, and by collecting a prize, the winner acknowledges and accepts that driving, travel and any other activities comprising the prize, are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. The Promoter is not responsible for any acts of god, such as adverse weather conditions or industrial action or civil commotion that may occur whilst the winner is travelling. It is the responsibility of the prize-winner to enquire about local issues and conditions at destinations prior to travel. The Promoter does not guarantee that the winner will enjoy the travel prize or be suited to the type of travel prize that is offered.
  6. Travel arrangements to and from the winner’s home and the prize location do not form part of the prize and are the responsibility of the winner and their travelling companion/s. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.

Further Terms and Conditions

  1. Any entrant found to have used a third party (including online competition entry site) to enter on their behalf will have all entries invalidated and any claim they have to any prize will be invalidated. If such an entrant is awarded a prize and then found to have breached this clause, the entrant must immediately return any prize awarded. The Promoter has sole discretion to determine if this clause has been breached by any entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the entrant has breached this clause. An entrant must provide any requested documentation to the Promoter upon request. The Promoter reserves the right to disqualify any entrant who provides false information or who seeks to gain an unfair advantage or to manipulate this competition.
  2. Any entrant found to be entering incorrect contact details, including incorrect email contact details, will have all entries invalidated and any claim to any prize will be invalidated. If such an entrant is awarded a prize and then found to have breached this clause, the entrant must immediately return any prize awarded. The Promoter has sole discretion to determine if this clause has been breached by any entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the entrant has breached this clause. An entrant must provide any requested documentation to the Promoter upon request.
  3. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State and Territory legislation. Cash will not necessarily be awarded as a substitute. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize supplier’s requirements. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.
  4. The Promoter highly recommends a current residential street address be provided when requested for ease of correspondence and potential prize delivery. The Promoter makes all reasonable efforts to deliver prizes to the addresses provided by competition entrants. The Promoter cannot guarantee that any prizes returned to the Promoter due to non-delivery at the provided address will be re-sent to the prize winner.
  5. The Promoter reserves the right to request winners to sign a winner’s deed of release (and indemnification) or any other relevant forms or agreements that the Promoter deems necessary, to provide proof of identity, proof of age, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill) in order to claim a prize. Proof of identification, residency, age and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
  6. The Promoter reserves the right to conduct new round of judging in the event that an entrant, claiming to be a winner, is unable to satisfy these Terms and Conditions or has breached these Terms and Conditions.
  7. The Promoter’s decision in relation to any aspect of the competition is subject to State and Territory legislation but also final and binding on each person who enters. No correspondence will be entered into. No responsibility is accepted for late, lost or misdirected entries. Prizes are subject to availability, not transferable or exchangeable and, with the exception of cash prizes, cannot be taken as cash. Prizes will be sent to the winner’s nominated address as stated in their original entry. The Promoter and their associated agencies, and companies associated with this promotion will take no responsibility for prizes damaged or lost in transit.

  1. Copyright, Statutory guarantees, Waiver and liability

  1. All entries and any copyright subsisting in the entries become and remain the property of the Promoter who may publish or cause to be published any of the entries received.
  2. In participating in the prizes, the winners agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The winners (and their companions) agree to granting the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide, including online social networking sites, and the winners (and their companions) will not be entitled to any fee for such use.
  3. Prize-winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of that prize.
  4. The Promoter (subject to State and Territory legislation) reserves the right to amend, cancel or suspend this competition if an event beyond the control of the Promoter corrupts or affect the administration security, fairness, integrity or proper conduct of this competition. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this competition. In particular, computer generated entries and the use “scripting” is not permitted and will not be accepted.
  5. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
  6. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (‘Non-Excludable Guarantees‘).
  7. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Entrant; or (f) use of a prize The Promoter (including its’ officers, employees and agents) excludes all liability for any loss (including, without limitation, indirect, special or consequential loss or loss of profits or opportunity), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition including taking or using a prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law), including the Non-Excludable guarantees. Any change in value of the prize occurring between the publishing date and date the prize is claimed is not the responsibility of the Promoter.
